These Terms and Conditions ("Terms") govern your use of the website at https://thegourmetcloset.com (hereinafter referred to as the "Site") and any service provided through the Site, which is owned and operated by Decision Factor LLC  (hereinafter referred to as the "Company", "We", "Us", and any applicable pronoun). By signing up to use the Services through the Site or any related website, features, products, APIs, or mobile application (if applicable), you hereby agree that you have read, understood, and accept any and all provisions under these Terms, as well as, the Privacy Policy.

4.1 By placing an order through the Site, you are offering to purchase a product on and subject to these Terms. All orders are subject to availability and confirmation of the order price.

4.2 The Company reserves the right to refuse any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per household, or per order.

4.3 If we need to cancel or modify an order, we will notify you via email or phone provided at the time the order was made.

5.1 All prices are listed in US dollars and are subject to change without notice.

5.2 We strive to display accurate product information, including availability and pricing. However, errors may occur. In the event that an item is listed at an incorrect price or with incorrect information, the Company reserves the right to refuse or cancel any orders placed for that item.

6.1 Payment must be made at the time of purchase using one of the payment methods provided on the Site. We accept major credit cards and other payment methods as indicated on the Site.

6.2 By submitting your payment information, you authorize the Company to charge the applicable payment method.

  1. Shipping and Delivery

7.1 Shipping costs and delivery times are provided at checkout and may vary based on your location and the shipping method selected.

7.2 The Company is not responsible for delays caused by shipping carriers or customs clearance.

  1. Returns and Refunds

8.1 In case of a damaged product or a manufacturing error, We offer a free reprint or a refund if you contact us within 14 days of product delivery. You may contact us regarding returns and refunds by email or through the Site.

8.2 You may be required to provide a clear photo showing the issue. If there’s an issue affecting multiple products that use the same design, an additional photo (or video) of all affected items visible in one frame will be required for confirmation purposes.

8.3 The Company will not be held responsible and will not offer reprints or refunds if you ordered the wrong size or color, or simply changed your mind.

8.4 In case of an unsuccessful delivery, which could be due to various reasons, such as issues with the shipping carrier, incorrect address provided by you, or other logistical problems that prevent the product from being delivered, you can opt for either a reprint with an extra charge or a partial refund.

8.5 There is a tolerance of 0.5" for print placement, meaning that minor variations in the placement of the print will not be considered as defects.

8.6 To be eligible for a return, your item must be in the same condition that you received it, unworn or unused, with tags, and in its original packaging. You’ll also need the receipt or proof of purchase.

8.7 If your return is accepted, we’ll send you a return shipping label, as well as instructions on how and where to send your package. Items sent back to us without first requesting a return will not be accepted.

8.8 Certain types of items cannot be returned, like perishable goods (such as food, flowers, or plants), custom products (such as special orders or personalized items), and personal care goods (such as beauty products). We also do not accept returns for hazardous materials, flammable liquids, or gasses. Furthermore, we also cannot accept returns on sale items or gift cards. Please get in touch with us if you have questions or concerns about your specific item.

8.9 We will notify you once we’ve received and inspected your return, and let you know if the refund was approved or not. If approved, you’ll be automatically refunded on your original payment method within 10 business days. Please remember it can take some time for your bank or credit card company to process and post the refund too. Please contact us by email if more than 15 business days have passed since we’ve approved your return.

  1. Limitation of Liability

9.1 To the fullest extent permitted by law, the Company shall not be liable for any indirect, incidental, special, or consequential damages arising out of or in connection with the use of the Site or the purchase of products from the Site.

9.2 The Company's total liability to you for any claim arising from or related to the Site or the products purchased through the Site shall not exceed the amount paid by you for the product in question.
